These Terms of Service govern your access to and use of 3DAILY Studio for Business, operated by My3dSelfie, Inc. at studio.3daily.com (the "Service", "we", "us", "our"). By creating an account, purchasing a subscription, buying credits, or using the Service in any way, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

1. Eligibility
You must be at least 18 years of age and have the legal authority to enter into contracts on behalf of your organisation to use the Service. By using the Service, you represent and warrant that these requirements are met.
2. Accounts
2.1 Registration
You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
2.2 Team Members
You may add team members to your workspace. You are responsible for all actions taken by team members under your account. You must promptly remove access for any team member who should no longer have it.
2.3 Account Security
Notify us immediately at [email protected] if you suspect unauthorised access to your account. We are not liable for losses arising from your failure to maintain account security.
3. The Service
3DAILY Studio for Business provides business clients with access to a 3D production platform, including: instant AI-generated digital outputs (3D concept models, renders, videos, brochures); credit-based production services; production-ready digital custom products created by certified artists; brand workspace and asset management tools; and distribution tools for publishing assets to connected channels.
4. Subscriptions and Billing
4.1 Plans and Pricing
The Service is offered on the following subscription tiers: Studio Starter at $99 per month (16,000 credits); Studio Growth at $249 per month (45,000 credits); and Studio Scale at $499 per month (100,000 credits). Annual billing is available at the equivalent of 10 months’ pricing. Current pricing is always available at studio.3daily.com/pricing.
4.2 Automatic Renewal
Subscriptions renew automatically at the end of each billing period. By subscribing, you authorise us to charge your payment method on each renewal date. You may cancel at any time through your account settings; cancellation takes effect at the end of the current paid period.
4.3 Credits
Credits are allocated at the start of each billing period and expire at the end of that billing period; unused credits do not roll over. Expired credits are forfeited with no cash value. Credits cannot be transferred, sold, or redeemed for cash.
4.4 Payments
All payments are processed by Stripe, Inc. By providing payment information, you authorise us to charge the applicable fees. Prices are stated in USD. We reserve the right to change pricing with at least 60 days’ written notice to active subscribers.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Upload or submit content that infringes any intellectual property, privacy, publicity, or other rights of any person or entity
- Upload or submit content that is unlawful, defamatory, obscene, harassing, or abusive
- Use the Service or its outputs to train, develop, or improve any competing AI or machine learning system without our express written consent
- Attempt to reverse engineer, decompile, or extract the source code or underlying models of the Service
- Scrape, mine, or harvest data or outputs from the Service without our written consent
- Attempt to bypass, disable, or interfere with any security feature of the Service
- Represent yourself as the creator of the underlying AI methodology or artist systems
- Use the Service for any fraudulent, misleading, or prohibited purpose
6. Your Content
You retain ownership of all content and materials you upload to the Service. By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, copy, process, modify, and display your content solely to provide the Service and fulfil your orders.
You represent and warrant that you own or control all rights in your uploaded content, your content does not infringe any third-party rights, and your content is lawful and suitable for use in the production of 3D digital outputs.
7. Outputs and Intellectual Property
7.1 Commercial Licence
Subject to your compliance with these Terms and full payment of applicable fees, we grant you a perpetual, worldwide, royalty-free, non-exclusive licence to use, reproduce, distribute, display, and create derivative works from any digital output produced through the Service for commercial or non-commercial purposes.
7.2 White-Label Outputs
On Studio Growth and Studio Scale plans, outputs may be delivered without 3DAILY branding. You may present white-label outputs to your clients as part of your own deliverables. You may not represent yourself as the creator of the underlying AI or artist methodology.
7.3 Our Intellectual Property
All rights in the Service, platform, tools, software, branding, methodology, and underlying content are owned by us or our licensors. Nothing in these Terms grants you any rights in our intellectual property except as expressly stated.
7.4 No AI Training
You may not use any output produced through the Service, or any access to the Service, to train, develop, fine-tune, or improve any AI or machine learning model without our express prior written consent.
8. Production Quality
AI-generated outputs may vary. Artist-assisted outputs involve creative interpretation. Previews may differ from final delivered results. We do not guarantee that any output will meet your subjective expectations or be suitable for any specific third-party platform, marketplace, or commercial purpose unless expressly stated in writing.
9. Distribution Channels
Where you connect third-party distribution channels (such as Shopify, Etsy, or Amazon), we will publish your assets to those channels on your instruction. You are solely responsible for ensuring your use of those channels complies with their respective terms of service. We are not liable for any consequences arising from third-party platform policies or downtime.
10. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Service and all outputs are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
11. Limitation of Liability
To the fullest extent permitted by applicable law:
- Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the total fees paid by you in the 12 months immediately preceding the claim
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, loss of goodwill, or business interruption, however caused
- We are not liable for any failure or delay caused by events outside our reasonable control
Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes liability for fraud or any liability that cannot be excluded under applicable law.
12. Indemnification
You agree to indemnify, defend, and hold harmless My3dSelfie, Inc., its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: your breach of these Terms; your uploaded content; your misuse of the Service or its outputs; or your violation of any applicable law or third-party rights.
13. Termination
13.1 Termination by You
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current paid billing period. Your workspace data will be retained for 90 days following cancellation, after which it will be deleted.
13.2 Termination by Us
We may suspend or terminate your access to the Service immediately if: you breach these Terms and fail to remedy the breach within 7 days of written notice; you fail to pay fees when due; we reasonably suspect fraudulent or unlawful use; or we are required to do so by applicable law. On termination for cause, no refunds are owed. On termination by us without cause, we will refund pro-rata subscription fees for the unused portion of your current billing period.
13.3 Effect of Termination
On termination, your right to use the Service ceases. All licences granted under these Terms for outputs produced prior to termination remain in effect, subject to any refund obligations. Sections that by their nature should survive termination will do so.
14. Changes to the Service and Terms
We reserve the right to modify, suspend, or discontinue the Service or any feature at any time. We will give at least 30 days’ notice of any material reduction in features available to active subscribers. We may update these Terms from time to time. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
15. Governing Law
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any dispute shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, United States. You and we both consent to personal jurisdiction in those courts.
16. General
- Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and My3dSelfie, Inc. regarding the Service.
- Severability: If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and all other provisions remain in full force.
- Waiver: Failure to enforce any provision is not a waiver of the right to enforce it in future.
- Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights to an affiliate or acquirer without your consent, with notice to you.
- Notices: Notices under these Terms must be sent to [email protected] (for us) or to the email registered to your account (for you).
- Language: These Terms are written in English. In any conflict between translations, the English version controls.
